Please read these Terms and Conditions (the "Terms") carefully. They form a binding agreement between you and Susan Rose Reed, doing business as EQ NAV ("EQ NAV," "we," "us," or "our"), and they govern your access to and use of the EQ NAV mobile application, the website at eqnav.com, and all related features and services (together, the "Service").
Section 20 contains an arbitration agreement and class action waiver that affects your legal rights. Please read it carefully.
By downloading, installing, creating an account for, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you are a parent or guardian giving consent for a minor, you agree to these Terms on that minor's behalf and are responsible for their use of the Service.
EQ NAV is a free mobile application for the equestrian community in the United States. The Service currently includes: (a) Scoring Analysis, which helps riders review competition results and track progress; (b) Goal-Based Recommendations and Task/Goal Tracking, which organize goals, recommendations, and performance insights; (c) a Personalized AI Chatbot; and (d) a Social Feed and Community where riders, coaches, and enthusiasts connect. We may add, change, or remove features at any time.
EQ NAV uses competition and scoring data obtained from the United States Equestrian Federation ("USEF") and the United States Hunter Jumper Association ("USHJA"). You acknowledge and agree that:
You must be at least 13 years old to use the Service. If you are between 13 and 17 (or under the age of majority where you live), you may use the Service only with the verifiable consent and supervision of a parent or legal guardian, who must agree to these Terms and who is responsible for the minor's use of the Service, including content the minor posts and any interactions the minor has with other users. We do not knowingly allow children under 13 to use the Service. If we learn that a child under 13 has provided personal information, we will delete the account and related information. A parent or guardian may contact us at sulu@eqnav.com to review, request deletion of, or withdraw consent for a minor's account.
By using the Service you also represent that you are not barred from using it under any applicable law and that you reside in the United States.
The Service is currently provided free of charge. We may introduce paid features in the future. If we do, we will update these Terms and give you notice before any charge applies, and you will not be charged for anything without your agreement. Standard carrier, data, and device charges from third parties remain your responsibility.
Waitlist and early access. If you join our waitlist, we may contact you with launch updates and early-access invitations, and you may unsubscribe at any time. Early-access status, queue position, referral rewards, and "founding member" perks are provided at our sole discretion, have no cash value, are not transferable, and may be changed, limited, or withdrawn at any time. Joining the waitlist does not guarantee access to the Service. We may remove referrals we believe are fraudulent, automated, or abusive.
Scoring analysis, insights, goals, and recommendations are provided for informational and educational purposes only. They are generated from available data and algorithms and are not a guarantee of future results, placement, qualification, or improvement. They are not professional training, coaching, veterinary, medical, or safety advice and do not replace the judgment of you, your trainer, or other qualified professionals.
The Service includes an AI chatbot that answers questions about riding, training, competition preparation, and the platform. You understand and agree that:
Your content. You may post text, photos, videos, comments, and other material ("User Content"). You retain ownership of your User Content. By posting it, you grant EQ NAV a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, adapt, and otherwise use your User Content in connection with operating, promoting, and improving the Service. This license continues for a reasonable period after you delete content to allow for backups and for copies already shared by other users, and ends otherwise when you delete the content or your account.
Your responsibility. You are solely responsible for your User Content and represent that you own it or have the rights and permissions needed to post it, including permission from any person, horse owner, or minor who appears in it. Do not post images or information about another person, particularly a minor, without appropriate consent.
No endorsement. User Content reflects the views of its authors, not EQ NAV, USEF, or USHJA. We do not guarantee its accuracy and are not responsible for it. Interactions with other users are solely between you and them. Use caution and good judgment when sharing personal information or arranging to meet anyone in person, and minors should always involve a parent or guardian.
Moderation. We may, but are not obligated to, monitor, review, remove, or restrict any User Content or account at our discretion, including for violations of these Terms or to protect users or the Service.
Coaches may share experience, insights, and educational content with the community at no charge. Coaches may be subject to a verification process, and we may approve, decline, or revoke verified status at any time. A verified badge means only that we reviewed information a coach submitted; it is not an endorsement, certification, or guarantee of a coach's qualifications, safety record, competence, or the quality of their advice. Coaches must provide accurate information about their credentials and experience, must comply with all applicable laws and the rules of USEF, USHJA, and any safe-sport requirements that apply to them, and may not use the Service to solicit payment, sell services, or promote products without our prior written approval. Coach content is for general information only and does not create a coaching or professional relationship through the Service. Riders and parents are responsible for evaluating any coach before engaging with them outside the Service.
You agree not to:
Safety and reporting. If you believe a child or any other person is in immediate danger, contact local emergency services first. Concerns about abuse or misconduct involving minors in equestrian sport may also be reported to the U.S. Center for SafeSport (uscenterforsafesport.org). You may also report concerning content or conduct on the Service to sulu@eqnav.com, and we will review reports and take action we consider appropriate. Nothing in these Terms limits any person's right or duty to report suspected abuse to the authorities.
The Service, including its software, design, text, graphics, logos, the EQ NAV name, features, and analytics, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on your personal device for its intended purpose, subject to these Terms. All rights not expressly granted are reserved. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free right to use them without obligation to you.
Copyright complaints. If you believe content on the Service infringes your copyright, send a notice to sulu@eqnav.com that includes: your contact information; a description of the work claimed to be infringed; the location of the material in the Service; a statement that you have a good-faith belief the use is unauthorized; a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the owner; and your signature. We may remove material and terminate repeat infringers' accounts.
Our Privacy Policy, available at eqnav.com/privacy-policy.php, explains how we collect, use, and share your information, including information from minors and information processed by AI features. By using the Service you consent to those practices.
The Service may rely on or link to third-party services, data sources, and websites, including USEF and USHJA, app stores, and AI providers. We do not control them and are not responsible for their content, availability, accuracy, or practices. Your use of them is subject to their own terms. Apple and Google are not sponsors of and have no obligation to support the Service. Where you download the app from the Apple App Store or Google Play, you acknowledge these Terms are between you and EQ NAV only, and that Apple and Google are third-party beneficiaries of these Terms with the right to enforce them as they relate to your use of the app as permitted by their terms.
Horseback riding and equestrian competition are inherently dangerous activities that carry a risk of serious injury, death, and property damage. EQ NAV does not provide riding instruction, supervise any activity, or evaluate horses, facilities, trainers, or events. Nothing in the Service should be treated as a recommendation to ride, compete, or train in any particular way. You are solely responsible for your own safety and the safety of your horse and others, and you assume all risks of participation in equestrian activities.
You may stop using the Service and delete your account at any time through the app or by contacting sulu@eqnav.com. We may suspend, restrict, or terminate your access at any time, with or without notice, if we believe you violated these Terms, created risk or legal exposure for us or others, or for any other reason, including discontinuing the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive, including Sections 3, 7, 8, 9 (license), 12, 15, and 17 through 23.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, ITS DATA, SCORING ANALYSIS, RECOMMENDATIONS, OR AI RESPONSES WILL BE ACCURATE, COMPLETE, RELIABLE, SECURE, UNINTERRUPTED, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EQ NAV AND ITS OWNER, AFFILIATES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, QUALIFICATIONS, OR COMPETITION OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). BECAUSE THE SERVICE IS FREE, THIS LIMIT REFLECTS A FAIR ALLOCATION OF RISK. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.
You agree to defend, indemnify, and hold harmless EQ NAV and its owner, affiliates, and contractors from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right. For minors, this obligation applies to the parent or guardian who consented to the minor's use.
Informal resolution first. Before filing any claim, you agree to contact us at sulu@eqnav.com and try in good faith to resolve the dispute for at least 30 days.
Binding arbitration. If the dispute is not resolved, you and EQ NAV agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court of competent jurisdiction. Arbitration may be conducted by video or telephone, or in the county where you live, at your election.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to stop infringement or misuse of intellectual property.
Class action waiver. To the extent permitted by law, you and EQ NAV each agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not consolidate claims or preside over a class proceeding.
Right to opt out. You may opt out of arbitration and the class action waiver within 30 days after first accepting these Terms by emailing sulu@eqnav.com with the subject line "Arbitration Opt-Out" and your name and account email. Opting out does not affect any other part of these Terms.
Minors. If you are a minor, your parent or guardian agrees to this Section on your behalf.
These Terms are governed by the laws of the Commonwealth of Virginia and applicable U.S. federal law, without regard to conflict-of-law rules. For any dispute not subject to arbitration, you and EQ NAV consent to the exclusive jurisdiction of the state and federal courts located in the Commonwealth of Virginia.
We may update these Terms from time to time. When we make material changes, we will notify you through the app, by email, or on our website and update the "Last Updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, you must stop using the Service. We may modify, suspend, or discontinue any part of the Service at any time.
